Inquiry to company made August 26, 2019. On August 26, 2019 company responded with the following statement: "As of January 2019, Patagonia’s employee arbitration agreement excludes claims for gender harassment, including sexual harassment."

Follow up inquiry sent to company with a request for clarification as to whether it simply does not include arbitration language or whether it requires arbitration with an opt out provision.

Company responded, "Our arbitration agreement has a paragraph that notes in writing that claims for gender harassment, including sexual harassment are specifically excluded from the definition of 'Claims' that are covered by the Arbitration agreement."
